Investors review offering materials, confirm eligibility requirements, and consult independent immigration and financial advisors before making an investment decision.
Upon acceptance into the offering, investors execute subscription documents and fund their investment in accordance with the private placement documents. Capital must be placed “at risk” as required under EB-5 regulations.
Following investment, immigration counsel files Form I-526E with U.S. Citizenship and Immigration Services (USCIS) under the Regional Center program, demonstrating lawful source of funds and compliance with program requirements.
Upon I-526E approval and visa availability, the investor and eligible family members may obtain conditional permanent resident status for a two-year period.
Current USCIS policy requires that invested capital remain at risk and deployed in the underlying project for a minimum period of approximately two years from the date the funds are deployed. This sustainment requirement is separate from the timing of the Form I-829 adjudication process.
Capital return timing is governed by the terms of the applicable offering documents and project structure. USCIS rules require invested funds to remain at risk for at least two years from deployment to the underlying project. Third Lake’s EB-5 investments are typically structured with loan maturities of approximately three to five years. Repayment is not guaranteed and depends on project performance and liquidity. Investors should refer to the specific offering documents for complete terms and conditions.
